Abstract
The LGBTQ+ community, particularly transgenders, continues to face stigma and discrimination despite the decriminalization of Section 377 in India. This paper explores the challenges and limitations faced by transgender individuals in terms of their Sexual and Reproductive Rights (SRRs).
While the Transgender Persons (Protection of Rights) Act, 2019 recognizes the rights of transgender individuals, it fails to address their SRRs. Transgender men have the ability to conceive and carry a pregnancy to term, while transgender women face limitations in this area. The healthcare system lacks gender-inclusive language and fails to provide adequate care and support for transgender individuals. There is a lack of trained professionals to perform gender confirmation surgeries, and private surgeries are prohibitively expensive. Reproductive rights for transgender individuals are not recognized in current laws and acts.
This paper calls for gender-inclusive healthcare laws, training for medical practitioners, gender-inclusive language, inclusion in the Maternity Benefit Act, and comprehensive sex education. Sensitization of society and proper implementation of existing laws are crucial steps towards ensuring equal rights and healthcare for transgender individuals. Challenging traditional stereotypes and promoting acceptance and inclusivity for all genders in society is extremely crucial.
